The semen sold in through this website is guaranteed to be of acceptable quality by the seller and to be in good condition. Conception rate will not be guaranteed. All shipping and handling expenses will be assumed by the buyer.

EMBRYO PACKAGES
All embryos must be grade one or grade two. The seller guarantees the description and genetic background of the embryos selling. Conception rate cannot be guaranteed. If a certified embryo technician is used to implant the embryos, the seller agrees that one pregnancy will be guaranteed unless noted otherwise. The choice of an embryo technician may be agreed upon by both the seller and buyer. The buyer is responsible for all shipping and implantation costs. Each package may list specific terms; please visit each individual package for additional information.

THE RIGHT TO FLUSH
A right to flush lot will carry these guarantees: a minimum of 5 grade one transferable embryos will be guaranteed to the buyer. If the cow produces more than 5 embryos they are ownership of the buyer at the same price as the auction price. If the cow produces less than 5 embryos, the cow can be flushed again to meet the minimum or the money can be returned to the buyer based on a prorated price per embryo. The buyer will incur all costs associated with the flush. A certified technician agreed upon by the buyer and seller will perform the flush. The flush will be performed at the seller's convenience within a reasonable amount of time from the sale of the flush. The seller must give a time frame of when the donor is available to flush. If an agreement for a flush date and location is not met, the seller may be required to refund one half of the purchase price. Information regarding the flush, i.e location, schedule, will be noted on each lot. Specifics regarding minimums, technicians, dates and semen may also be noted.

LIVE ANIMAL SALES
Information provided by the seller must be accurate and complete. The terms of the lot must also be very specific to include the sale of ownership or interest. The transfer of the animal and other services rendered by the buyer and seller must be handled between such parties.

BREEDING GUARANTEE AND GENETIC DEFECT INFORMATION
In light of the Genetic Defect Policy adopted by several breed associations, sellers must agree to provide any information pertaining to these defects deemed related to any lots for sale. If resulting calves from embryo package lots are verified as defective by the breed associations, the buyer must submit proof of this defect via DNA test to the seller. The dealings and further discussion regarding these calves must involve only the buyer and seller. Breed associations should be contacted for more information if needed as The Semen Bank, the buyers nor the breeder can guarantee the potential genetic defects of an animal or a mating.

SHIPMENT OF EMBRYOS AND SEMEN AND REGISTRATION REQUIREMENTS
All shipping and handling costs are the responsibility of the buyer. The seller agrees to use a reputable shipper and have the shipment arrive in good condition. Buyers must contact The Semen Bank to arrange shipping on purchased embryos and semen. The Semen Bank will provide the seller with a complete shipping address and instructions from the buyer. Buyer will provide upfront payment of the shipping and handling costs to the shipping company in way of a cashier's check, credit card or information required by COD shipping. Insurance on the product shipping is recommended. The seller assumes all responsibility for the transfer and registration of paperwork for registered animals through breed associations.
